Contract Question

ND

I bid and received a contract for an apartment with a scope of work being roofing, gutters, and siding with a tentative roofing install date of September. The GC over excavated and pushed the project back minimum 3 months. Now the roofing install date is mid December. I live in ND and we have severe winters and normally do not take on any winter work due to the problems associated with a cold install. I recently notified the GC that I want to cancel my contract due to I did not bid for a winter install and that my scope of work should be re-bid. I have not heard back from the GC any thoughts on this? Has anybody come across this before?

All of my contracts say snow removal is excluded.

When I have GC's wanting single ply installed sub freezing I simply send the TDB/PDB stating 40 and rising.

If the siding is vinyl, good luck with that. It'll shatter often sub freezing.

Rather than cancel, Mike H has a good idea regarding the letter. Not sure it needs to be notarized, but can't hurt. Certified is a good idea though.

Or send a notorized, certified copy of a list of things you will not do unless the weather is "...", then if it doesn't get roofed until April, it's not your problem.
